The news that the European Commission has issued a tender for a one-year market study into the AIFMD is simply the first step in the review process. Where this will become interesting will be when we can see the content of the survey: that could give us some indication of supervisory priorities. The possibility that no UK managers will be asked to complete it could also be something to watch.
The outcome will certainly give us pause for thought on how, for example, post Brexit, the UK, as a third country, can continue to access European markets and how our ‘AIFM’ regime may itself need to evolve.
